In a bombshell development, Kevin Costner's legal team has requested the dismissal of a lawsuit filed by stuntwoman Devyn LaBella, who claimed she was subjected to an unscripted rape scene on the set of his long-awaited western epic, Horizon: An American Saga - Chapter 2. But in a stunning twist, LaBella's own words have been used against her as evidence that she fabricated the entire ordeal.

According to TMZ, Costner's lawyers argue that LaBella altered her version of events in her latest legal documents, revealing that stunt coordinator Wade Allen had indeed met with her beforehand and explained the scene. This, they claim, is a clear contradiction of her initial complaint, which stated that she was not warned about the scene.

But that's not all - it appears that LaBella may have been trying to pull the wool over everyone's eyes from the very beginning. Her own texts, obtained by Us Weekly, show that she sent a glowing review of the shoot to stunt coordinator Wade Allen just days after the alleged incident. In one text, she even thanked him for "these wonderful weeks" and raved about how happy she was with the way things turned out.

Costner's lawyers are seizing on this as proof that LaBella is lying through her teeth. "These claims are not only groundless, they're ridiculous," Marty Singer, Costner's attorney, told TheScholarlyNote.com in an exclusive interview. "We have 12 independent witnesses who confirm that Ms. LaBella's claims are fabricated."

But LaBella's team is pushing back hard against the accusations. In a scathing response to Costner's lawyers, they accused them of "mansplaining" to LaBella what her own experience was on set. "She has sworn under oath to the truth and has produced contemporaneous proof to back it up," LaBella's attorney fired back. "Ms. LaBella's claims have never wavered or changed since the day she first reported this terrible incident to production in May 2023, right after it occurred."

So what exactly did happen on the set of Horizon: An American Saga - Chapter 2? According to LaBella's original complaint, she was filming a scripted rape scene with an intimacy coordinator present when suddenly, the next day, Costner decided to improvise an unscripted rape scene without any warning or safety measures in place. She claimed that co-star Roger Ivens put his hand on her breast and vaginal areas, leaving her feeling "trapped" and helpless.

But now, it seems that LaBella's story may be unraveling at the seams. In her new documents, she claims that she was menstruating on set when her pantaloons were ripped from the waist down to the crotch by Ivens, exposing her underwear. But Costner's lawyers say this is just another attempt to pad out a fake narrative.

The drama surrounding Horizon: An American Saga - Chapter 2 has been brewing for months, with rumors of costly delays and creative differences between Costner and his team. The film premiered at the Venice Film Festival last year to dismal reviews and has yet to receive an official release date. But one thing is certain: Kevin Costner is not going down without a fight.

"I don't know how I'm gonna make 3 right now, but I'm gonna make it," he vowed to reporters earlier this year, promising to push through the challenges facing his beloved western epic. "I've gotta go put my hands on it again and start to push it up. It's a rope that I cannot let go of."

For LaBella, however, the clock is ticking. With her claims crumbling under scrutiny, she faces the very real possibility of losing everything - including her reputation. As for Costner? He remains resolute in his determination to clear his name and prove the truth about what really happened on the set of Horizon: An American Saga - Chapter 2.

But Costner provided a screengrab of a May 11, 2023 text written by Devyn to stunt coordinator/2nd unit director Wade Allen thanking him for 'these wonderful weeks' and gushed 'I'm really happy it worked out the way it did'

On August 19, the two-time Oscar winner provided the Daily Mail several on-set snaps of LaBella smiling on set with him, and shots of her and Roger filming the scene where her costume remained on her body

In an August 19th declaration to formally dismiss the lawsuit, Kevin insisted the aerialist's pantaloons and petticoats remained undisturbed and there was no nudity, rape, simulated sex, or physical contact between the performers

It's been a year since Horizon: An American Saga - Chapter 2 premiered at the Venice Film Festival where it received dismal reviews and there is still no release date
